Welcome to the Austrian Nikon Store (the” Store”). By accessing the Store, you agree to be bound by the following terms and conditions (the “Terms and Conditions”). If you do not accept these Terms and Conditions, do not use the Store.

("Nikon Europe") provides this Store to you (“You”) on the basis of the following Terms and Conditions. These Terms and Conditions may be updated by Nikon Europe from time to time by posting the updated Terms and Conditions on the Store without prior separate notification to You, and for Your accessing the Store in any time in the future, such updated Terms and Condition in force then shall apply. You should check the Terms and Conditions each time You access the Store to check for updates.

2. The Store

The Store and any services and products that You may purchase through the Store are for Your non-commercial, personal use only and must not be used for business purposes. You will be able to obtain information about certain products and services via this Store and You may also submit queries to Nikon Europe to receive more information. Please note that the Store is intended for Nikon’s Austrian customers and purchased goods will be shipped to Austria only. If You wish to purchase prod-ucts from another country than Austria, please visit the relevant national Nikon Store.

3. Purchases

3.1 You can purchase products and services via this Store by selecting a product or several products and proceeding to the check-out. If You have not already registered an account at the Store, You will be requested to register in order for Your purchase order to be processed. All purchases that You may make via this Store will be administered by and purchased from Nikon Europe. You thereby enter into a purchase agreement with Nikon Europe.

3.2 You enter into a purchase agreement by placing an order and filling in the required details at the check-out, including the details enabling the method of payment that You have selected. Provided the selected product(s) are available and in stock, Nikon Europe will take payment in accordance with Your order. Any rejected or revoked payments are subject to an administrative fee.

3.3 Nikon Europe cannot guarantee that all product(s) are available. However, if a product is temporarily out of stock, You may still be given the option to enter into a purchase agreement, but You will be notified that delivery may take longer than otherwise stated.

3.4 When Your purchase order is completed, a receipt confirming the purchase order will be sent to the e-mail address that You have registered. Once this confirmation receipt is sent by Nikon Europe, the purchase agreement is valid. The receipt will include information regarding Your right to withdraw from the purchase agreement and any information You may need to access this right as well as information regarding complaints. The product(s), including applicable warranties, will be delivered to the delivery address that You have registered with the Store within reasonable time, usually within 3-10 working days of Your receipt of purchase, provided the product(s) are in stock.

4. Right to withdraw from the purchase

4.1 If You for any reason wish to cancel a purchase, You may do so within two weeks (14 days) from receiving the product(s) or within two weeks (14 days) from the date of purchase of a service. You must in such case notify the Nikon Europe call center at the following telephone number:

You will thereafter be provided with a return form for the product(s). The cancelled product(s) must then be returned to the address notified to You by Nikon Europe. It must be in the condition in which You received it and packed in accordance with Nikon Europe´s instructions. You may open the packaging and examine the product(s). However, the product(s) must be returned undamaged and properly packaged for the cancellation to be valid. In case You have damaged or the Product is not properly packaged, no cancellation right applies. If only part of the product(s) is returned, only a correspondingly deducted purchase price will be refunded to You.

Nikon Europe will pay the cost of postage of the product(s) to the return address. However, if Nikon Europe finds that the received product(s) is incomplete, You will be responsible for the payment of postage of any and all remaining parts of the product(s) that You wish to return.

Nikon Europe will return any charged payment for the purchase as soon as possible, at the latest within 30 days of Nikon Europe’s receipt of notice of cancellation and acceptance of the cancellation.

Please be informed that the above described right to cancel a purchase does not apply to software purchases, as downloaded software cannot be returned.

5. Complaints

Nikon Europe customer service will do its best to reply to any inquiries and process any complaints regarding the Store, services or products as soon as possible. If a faulty product is delivered to You, You may notify Nikon Europe without undue delay of discovering the fault and describe the problem.

6. Privacy policy

6.1 By entering into a purchase agreement in the Store, You agree to provide Nikon Europe with the accurate data as requested in the purchase or registration form and You agree to the following privacy policy. Nikon Europe reserves the right to decline a new registration or cancel an account at any time.

6.2 The information that You provide Nikon Europe with through the registration process or otherwise via the Store will be used by Nikon Europe, which for the purposes of this privacy policy will also include affiliates to Nikon Europe in the Nikon Group (“Nikon Affiliates”), for the purpose of providing the services and/or products that You have requested by way of the Store. Such personal data may include Your full name, address, e-mail address and telephone number.

6.3 From time to time Nikon Europe or Nikon Affiliates might use this information for marketing purposes or to inform You about other products and services, which we think might be of interest for You. 6.4 You agree that Your personal data might also be passed on to Nikon Affiliates and third parties in order to carry out the delivery of Your purchases, to the extent necessary in order for Nikon Europe to provide the services. This might involve a transfer of data outside the European Economic Area. Some of these recipients may be located in countries that do not have the same privacy laws as the EU Member States. However, You may rest assured that the necessary measures are in place to protect the confidentiality and security of personal data. Nikon Affiliates and third parties will use Your personal data exclusively upon instruction of Nikon Europe and exclusively for the purpose of carrying out the delivery of Your purchases. Nikon Europe will not transfer or sell Your personal data for any commercial or marketing reasons.

6.5 Small pieces of information known as cookies will be installed on Your computer to collect statistical information including navigation paths, number of visits, returning customers and hits per page. The only personal information that a cookie can con-tain is information that You provide Yourself. They cannot read data off Your hard disk. We use these cookies to help us determine the usefulness of the information that we provide and to see how user-friendly the Store is. Nikon Europe does not share the information that it gathers from cookies with non-Nikon Affiliates or sell it to third parties. If You prefer not to receive cookies from our Store, You can set Your browser to warn You before accepting cookies and refuse the cookie when your browser alerts You to its presence. You can also refuse cookies by turning them off in Your browser. Please be informed that some functions of the Store may not function if cookies are refused.

6.8 We will only process Your personal information for the duration necessary to allow us to provide the services that You have requested or for any additional period as required by law.

6.9 This privacy policy may be amended by Nikon Europe from time to time. We will notify You of any material changes affecting our use of personal data.

7. Disclaimer

7.1 Nikon Europe reserves the right at its sole discretion, to amend or withdraw any content or services offered as part of the Store.

7.2 The Store and any support are provided to You at no charge and are for Your personal and non-commercial use. Any support provided to You is for information purposes only. Nikon Europe reserves the right to make changes to the Store; or not reply to any queries; or not provide any support in connection with the Store.

8. Use

8.1 All materials included on this Store are the property of Nikon Europe, Nikon Affiliates and/or its suppliers and protected by copyright. You are authorized to view and download the materials for Your personal, non-commercial use only.

8.2 Nikon Europe reserves the right to at any time prevent You from using the Store and any services and to prevent You from making any purchases.

9. Liability

9.1 Nikon Europe excludes all liability for any loss or damage, direct or indirect, that You may suffer, in connection with the use of or inability to use this Store to the extent that such loss or damage was caused by Nikon Europe’ slight negligence.

9.2 Nothing in these Terms and Conditions shall limit Nikon Europe’s liability for personal injury caused by its negligence or any liability which cannot be excluded or limited under applicable law.

11. Governing law

These Terms and Conditions shall be governed by and construed in accordance with Austrian law. Disputes arising in connection with these Terms and Conditions shall be subject to the exclusive jurisdiction of the Austrian courts.
